Mother Charged in Infant Death to Be Released Until Trial

The young mother charged with her boyfriend in the beating death of her 20-month old son is to be released to her home until she goes to trial this summer, according to cbs4qc.com.



19-year-old Mireya Balderas will be allowed to live at her home with her father until she stands trial. A judge recently made the decision to allow this to happen, a decision for which her lawyer was very pleased.

Balderas faces one count of child endangerment resulting in death in connection with an abuse incident where her boyfriend, Jorge Perez, was allowed to brutally beat her 20-month-old son, Marcus Balderas.

The infant died from injuries sustained as a result of the beatings, the cause of death being deemed as blunt force trauma by the hospital investigation. Both Balderas and her boyfriend were arrested and charged.

According to reports, Perez admitted to an extensive amount of abuse on the boy and Balderas admitted to witnessing and allowing it to happen on more than one occasion.

Balderas will still technically be in the custody of the Iowa Department of Corrections while she is living with her father until her trial in July. Her lawyer released a statement that this was a good decision because they will be better able to prepare their defense case for her upcoming trial if she is able to reside at home instead of remaining in jail.

Her boyfriend will face trial separately in September with two charges of child endangerment resulting in death from the incident.
