Iowa Diversity Plan is Not Lawful

The  controversial plan that was proposed by the Iowa City school district has drawn more negative attention. According to a post on The Gazette website, the Iowa Department of Education has taken a look at the policy and ruled that it would violate federal law.



The Iowa City school board has passed two of three necessary votes on a new diversity policy that has raised an extensive amount of protest from the community.

The policy would transfer some students receiving free or reduced lunches to even out the numbers of these students between different schools within the district. According to the Iowa Department of Education, the districts' ability to access the information of students without permission from their parents is a violation of federal law.

This judgment has not stopped the school district, though. They still plan to proceed with the voting that is scheduled for another discussion this coming Monday.

They have stated that there are other ways to go about putting the plan into action without violating laws. The policy would have to be altered in its writing, but the school board seems willing to do to this.

According to a representative from the school board, the intention is not to violate the rights of the students at all, but to look at the numbers as a whole and allow students and families to voluntarily transfer from one district to another.

According to the school board, this does not necessarily violate the rights of the students by federal law and works with the district's open enrollment.
