Another New Trial for Mother Accused in Toddler's Death

The young mother accused in the death of her 20-month-old toddler has another new trial date, set separately from the date that she and her boyfriend originally faced together, according to an article on thegazette.com.



A judge in Johnson County agreed to try 19-year-old Mireya Balderas separately from her boyfriend. She was originally scheduled for trail Dec. 11 with her boyfriend, 21-year-old Jorge Perez.

Balderas expressed a desire to be tried separately from her boyfriend in hopes of avoiding association with him. Her attorney is pressing the question of why she has charges against her if her boyfriend admitted to all of the fault.

Balderas faces a charge of child endangerment resulting in death in connection with the case because she allowed her boyfriend to abuse her infant. This charge carries a sentence of up to 50 years.

Her boyfriend, Perez, faces two charges of child endangerment resulting in death because his abuse is believed to be the factor that directly led to the death of the infant on April 30, which was ruled a homicide by investigators. Each of the charges carries a sentence of up to 50 years.

Both were arrested June 10 on charges relating to the death of the infant. Perez admitted to hitting the infant, stepping on him, and throwing him on the floor. He also held a pillow over his head. Balderas admitted to hitting him and watching her boyfriend abuse him as well, according to reports.

Perez also approved a waiver of his right to a speedy trial, so he will not be facing trial on Dec. 11, either, but his new date has not been set as of yet.

The new trial date for Balderas is July 9.
