A judge in Iowa City recently ruled that a mother serving time in prison for murder will be allowed to see her children while she remains incarcerated, according to bradenton.com.
Tracey Richter was convicted of killing her neighbor and is serving prison time in Mitchellville for the crime. According to reports, Richter shot 20-year-old Dustin Wehde 11 times in 2001. Her two children were only a room away.
According to reports, the murder was part of a plan to frame Richter's ex-husband. Richter was arrested last year for her crimes. She allegedly created a hoax stating that she did it to protect herself and her children.
Richter is serving time in Mitchellville while she is appealing her murder conviction.
Judge Nancy Whittenburg has ordered that the father of Richter's children, Michael Roberts, has to take is children to visit the women's prison so that Richter can see her children three times during her term.
Roberts was planning to move to his native Australia with the children because his temporary visa has expired, but the judge ruled that this was not allowed until Richter is finished with her appeals.
The decision is not a completely popular one. Sac County Attorney Ben Smith made the statement that he cannot believe Richter has retained any of her parental rights due to the circumstances of the shooting.
Whittenburg ruled on the basis that Richter is an excellent parent, and that the visits will keep stability with both the mother and her children.
Roberts is currently living in an undisclosed California city with the children. Whittenburg ordered Roberts to disclose the address where he was living with the children. Roberts' attorney has stated that he is considering filing an appeal.
