The man accused in the death of a 20 month old at the end of April has waived his right to a speedy trial and will probably not be going to trial on September 4.
21-year old Jorge Perez faces two charges of child endangerment resulting in death, an accusation spurring from the arrest of Perez and his girlfriend, 18-year old Miraya Balderas on June 10.
Perez and Balderas were arrested after an investigation spurred from the death of 20 month old Marcus Balderas after he was taken to the hospital for breathing problems.
According to kcrg.com, results of the investigation revealed extensive abuse by both Balderas and Perez on the child, including blunt force injuries that led to his death.
Perez is charged with one count of child endangerment for a series of assaults before the incident that led to the child's death and one for the actual injuries that led to the death. Balderas is facing one count of child endangerment resulting in death for her involvement.
Perez filed the waiver yesterday, and his case has not officially been delayed as of yet, but he will not be facing trial on September 4 as scheduled.
Balderas already waived her right to a speedy trial earlier this month. Her court appearance is scheduled for December 11. She also filed a motion asking for an explanation of why she was being charged as well, which led to a written response explaining that Balderas endangered her son and participated in the pattern of abuse.
If convicted, both Perez and Balderas could face up to 50 years for each charge of child endangerment.
