Balderas Waves Speedy Trial

Mireya  Balderas, the mother charged in the death of her 20 month old child, has waved her rights to a speedy trial for one scheduled in December instead.



According to thegazette.com, 18-year old Balderas and her 21-year old boyfriend Jorge Perez, are both facing charges of child endangerment after the death of 20-month old Marcus Balderas on April 30. The two were arrested on June 10 for the crimes.

The Iowa Department of Human Services launched an investigation after Marcus was reported to have been left at home alone. Five days later, the police were called because he was reported to have breathing trouble. He died not long after. Medical examiners deemed the cause of death to be blunt force trauma. The death was ruled a homicide.

Perez admitted to several occasions of severe abuse on the child. Balderas admitted to abusing her child as well and not stopping her boyfriend from abusing the child, either.

Balderas has been charged with one count of child endangerment resulting in death because she allegedly participated in the abuse and did not stop her boyfriend from abusing the baby. The charges can get her up to 50 years in prison.

The two were originally set to go to trial on September 4, but Balderas waived her right to a speedy trial. Balderas will go to trial on December 11 instead.

Perez has not waived his rights and is still set for trail on September 4. He faces two counts of child endangerment resulting in death.
