Sex Offender Not Fit to Be Released

55 year-old Daniel J. Scott recently filed a motion to have his case evaluated for release from the Civil Commitment Unit for Sexual Offenders. The Iowa Court of Appeals found him to be a sexually violent predator and refused to allow the release.



Three years ago, Scott began a process asking to be released due to his physical incapability to continue performing any predatory, sexual acts again. The request was heard in May of 2011 and he was found to still be likely to perform the violent, sexual acts. The request was refused.

Scott appealed the ruling, stating the fact that he is physically unable to perform any of the predatory acts for which he remains lodged in civil commitment due to health problems and old age.

Scott has no remaining legs due to amputation from diabetes and a heart condition. Doctors testified to this on Scott's behalf at the appeal trial. The medical experts were divided on the decision as well.

One decided that his risk of offending again was not diminished due to any health conditions at all, noting the fact that two of the incidents for which the repeat offender was committed had occurred while Scott only had one remaining leg. The other leg had already been amputated due to diabetes.

The Iowa Court of Appeals found that Scott's mental condition had not changed, even though his health had and he should remain lodged in Civil Commitment for a longer period of time, as he was still a risk of committing the acts.
